11-Year-Old Child Arrested, Jailed For the Night Before Being Released to Parents

PINE FOREST (KBMT) -- It appears one Southeast Texas police officer is under close scrutiny following the arrest and incarceration of an 11-year-old child on Wednesday, May 27, 2009.

Sources tell KBMT 12 News ABC/NBC the boy was arrested, accused of trespassing and then thrown behind bars.

KBMT has been told the boy was approached by a Pine Forest police officer while riding his four wheeler in an area restricted from trespassing.

Sources say the boy got scared and took off on his four wheeler toward his Sugarmill Road home.

When the officer caught up with the 11-year-old he was arrested, handcuffed and booked into a Hardin County juvenile detention facility.

Sources say the child spent the night alone before he was released to his parents Thursday morning at the Orange County Courthouse.

The family has hired an attorney.

KBMT 12 News ABC/NBC contacted the Pine Forest police chief who says this is an ongoing investigation and would not comment directly on the case.

He told us by phone that the department's policy on arresting someone is clear.

I don't know what scanner you were listening to, but there was NEVER an assault issue here...NEVER NEVER NEVER - this is how rumors get started. I'm sure standard procedure was followed as in any juvenile felony case. He has legal representation, and the court will do what is in his best interest and the interest of the community, after a hearing of all evidence at disposition, should he be convicted. Juveniles enjoy due process of law. I would have no problem with my child being detained overnight for such an offense. We are a nation of laws, not men. We must respect the law and teach that respect of the law to our children.

The 11 year old deserved the detention he asked for. As a Police Officerm the kid did committ a crime by evading. The Officer made a wise and great choice by doing what he did. This is why the world is the way it is now days where people don't respect the law! If is wasnt for Officers and the jobs they perform, we would be in much worst shape. Open yoiur eyes people.

I have a 10yr old son and live in a rural area. Some children at that age are responsible enough to ride alone. He could have been doing worse things. And it should be up to the land owner as to weather or not charges are filed. If there were posted signs that said no tresspassing he should have stayed out. And if the boy assaulted an officer he should be punished. If that did not happen a few hours in jail should have been sufficient to make the boy realize what happens if you break the law.

An 11 yr old riding his 4 wheeler, even if he was trespassing, is not that huge of a crime. These officers acted like he was watering his pot farm, or breaking into a house. At least hes not in some gang, doing drugs or things alot of inner-city kids do. I hope the parents sue this police department and the officer is fired. Maybe he should be working at the SPCA, catching kittens and putting them in a cage. unreal.

OK people, the 11 year old will probably get probation for evading and it will probably be expunged from his record when he turns 18. Kids now a days are completely disrespectful of the laws in general. Parents need to quit whining about their poor baby being picked on cops, teachers, etc and face the fact that kids are a lot braver and bolder than they were when we were kids. Quit defending them every time they get in trouble, and let them take their lumps. How else will they learn??

I have an 11 year old son, and if he snuck off to go trespass on private property on a 4 wheeler without adult supervision, I would have had no problem with the law enforcement officials incarcerating him overnight to teach him a lesson. If you let your kids get away with criminal behavior, they will become criminals. Running from law enforcement is criminal behavior. So is tresspassing. He could have gotten hurt on someone else's property. 11 yr olds should not be on 4 wheelers unsupervised!

Where is OCPD? There is not an OCPD agency...maybe you mean OCSO? (Orange CO. Sheriff's Office) Of course the ones doing all the complaining are the ones that have probably been in trouble with the law. A crime is a crime. There should be no reason a child or adult runs from the police. It is stupid that people really think this child should not have gone to jail. What? A slap on the hand would be efficient? I think not! They need to be corrected now, before it becomes out of hand!

According to the what I heard over the police scanner, he was booked into the juvenile center for Aggravated Assault on a Public Servant. He was attacking the officer and he called for assistance so he wouldn't hurt the child.

Let the good kids grow up and be kids, they will be mischievous at times, but that is what kids do. Whatever happened to letting kids be kids? Sounds like the badge went to the officers head! The boy did not deserve to go to JAIL! Doesn't the police officer have some real crimes to take care of??? How about catching a drug dealer, or something a little more important, does he have to pick on a kid who is just being a kid? Facts: The parents were with the child until the time of the incident until they took him to Hardin County - they are NOT negligent parents. The boy is 11 and mischievous - as alot of them are - he did wrong and he admits it. He chooses to learn from this and hopes it will MAKE him and not BREAK him - as some of you seem to think should happen. All of you who "feed" on rumors, heresay and media garbage should be able to rest well tonight - now that you know the FACTS. Let this issue go away!

He wasn't just handcuffed. He was in handcuffs and shackles. And so much for the news trying to protect the identity of a juvenile by giving the street where he lives. Bottom line, I hope he learns from the night he spent in jail and I'm sure he has.

He might have done something wrong, however an eleven year old should not be handcuffed, arrested, and kept overnight in jail. It wasn't a violent crime, just a kid being mischievious.

Every child that appears before a juvenile court judge must have the representation of an attorney. So that is why his parents hired an attorney. As for the law, he committed a felony. I don't care how old he is. And if it is found that this is a one time incident, then it can be handled that way. Don't think 11 years old can't be criminals.

It is really easy to judge this family when you don't know the facts. Yes they hired an attorney because their child is facing serious criminal charges (felony) and for no other reason. Nobody is looking to make any money. They agree that their son should get in trouble, but come on, let the punishment fit the crime. For everybody who is here judging them, I'm glad you have perfect children and I hope that they never get into any trouble for making a mistake...because that is what he did.

Granted some of you are right that at least he wasn't getting into gangs or other "worse" activities, BUT the law is the law. It's like if you were to get a ticket and proclaim that instead of catching murderers and rapists theyre giving you a ticket. Well the law is the law. You just dont like that it happened to you! The Police Officer needed a break from writing tickets for unleashed dogs and cats. This isn't Beaumont but a rural area that needs to be unincorporated anyway. Unacceptable for this child to be jailed overnight at eleven years of age.Maybe this city needs to disband if this is the peak of services it is providing.

Instead of the parents getting an attorney, they should give a thankful acknowledgement to the officer for protecting their son and keeping him from getting into more mischief.No doubt,they think they will probably get a little cash out of this deal.They need to be fined themselves on behalf of their son.This officer was just doing what all officers should do without regard to age. Spending time in jail may make him think before he runs from the law again. He must have known he was some place he shouldn't have been or he would not have run. Why was an 11yo out on a 4 wheeler alone. Isn't that against the law also? Maybe this will be a wake up call for the parents. Those parents should have known where their son was at.Where were they? Thats whats wrong with kids now days, no supervision, left to themselves while mommy and daddy are out goofing off somewhere instead of being home with that little guy. I agree with tm and Ir. The CHILD should have been brought to his parents. If they wanted to 'teach him a lesson' then they should have went no further than taking him to the police station and have him sweat it out until his parents came for him.
